THE PROJECT
A global manufacturer expressed concerns that it didn't have the experience or legal know-how to develop commercial practices and procedures that comply with Australian competition and consumer laws and regulations, including the Australian Consumer Law.
HOW WE HELPED
We advised the global manufacturer on obligations to consumers under the Australian Consumer Law and the ramifications that it may face from the Department of Fair Trading and the ACCC if it fell foul of these obligations. In addition, we reviewed and amended the manufacturer's express product warranty, ensuring absolute compliance with the Australian Consumer Law.
THE PROJECT
A supplier with an extensive distribution network engaged us to prepare its dealer agreement and offer advisory services to its employees to ensure its effective and efficient implementation.
HOW WE HELPED
We prepared the dealer agreement to address cartel conduct and resale price maintenance issues, which were of particular concern to our client. We then provided hands-on training to employees in the sales and marketing team, particularly regarding online marketing and interstate sales.
